Poppy House Art Cafe: Participant Waiver, Assumption of Risk and Release of Liability
By participating in activities at Poppy House Art Cafe LLC (“Poppy House”), I acknowledge that creative and recreational activities involve certain inherent and ordinary risks. These may include, but are not limited to, cuts, scrapes, burns, allergic reactions, staining or damage to clothing or personal property, slips or falls, and injuries associated with the use of art and craft materials, tools, equipment, furniture, food, beverages, and other materials provided or used in the studio.
Assumption of risk
I voluntarily choose to participate in activities at Poppy House and knowingly assume the ordinary and inherent risks associated with my participation. I agree to use reasonable care, follow posted rules and instructions from Poppy House staff, and use tools and materials only as intended.
Release of liability
To the fullest extent permitted by Washington law, I release and hold harmless Poppy House Art Cafe LLC and its owners, employees, agents, and representatives from claims for personal injury, property damage, or other loss arising from the ordinary negligence of Poppy House in connection with my participation in Poppy House activities.
This release does not apply to gross negligence, reckless or intentional misconduct, or any liability that cannot legally be waived under Washington law.
Personal property
I understand that art materials may stain or damage clothing or personal belongings. I am responsible for protecting my belongings, and Poppy House is not responsible for lost, stolen, stained, or damaged personal property except to the extent liability cannot legally be waived.
Health, allergies & materials
I understand that the studio may contain or use paints, adhesives, glues, dyes, inks, clay, glitter, rhinestones, craft materials, food, beverages, and other substances that may cause sensitivities or allergic reactions. I am responsible for determining whether an activity or material is appropriate for me and for informing staff of relevant concerns before participating.
Minors
A parent or legal guardian must accept this agreement on behalf of any participating minor for whom they are legally authorized to provide consent. The parent or guardian accepts responsibility for supervising the minor as required by Poppy House rules.
Acknowledgment
I have had the opportunity to read this agreement before participating. I understand that this agreement affects legal rights, and I voluntarily agree to its terms.
By selecting “I have read and agree to the Poppy House Art Cafe waiver and release of liability” during booking, I acknowledge that I have read, understood, and agreed to this waiver.
